Generic Contest Rules including for Facebook, Instagram and Twitter

These Generic Contest Rules apply to all contests (“EAC Contest”) run and administered by Estonian Arts Centre (“EAC”) including those on Facebook, Instagram, Twitter or LinkedIn (or any other third party service, application or website) (a “Third Party Service”) unless applicability of other rules are specified.

By participating or attempting to participate in an EAC Contest, you are deemed to have received, understood, and agreed to these Official Rules.

Although the EAC Contest may be promoted, communicated, or administered by means of a third party, including but not limited to a Third Party Service, the EAC Contest is not sponsored, endorsed, administered by or associated with any Third Party Service.  Any questions, comments or complaints regarding the EAC Contest should be directed to EAC and not to any Third Party Service.

1.               ELIGIBILITY.  An EAC Contest is open only to residents of Canada, other than residents of Quebec, who have reached the age of majority in their jurisdiction of residence as of the date of entry.  The following individuals are not eligible to enter the Contest: a) employees, officers, and directors of: (i) EAC; (ii) contest co-presenters; and (iii) any prize suppliers; b) a household member and the immediate family (spouse, parent, child, sibling) of the individuals listed in (a) above.

2.              PRIZES. If the EAC Contest has more than one kind of prize, the first drawn winner will have his or her choice from among the prizes and the next drawn winner the next choice and so on.  EAC will make commercially reasonable efforts to facilitate winners to receive the prize they desire.  If efforts to reassign prizes according to winners’ wishes is not successful or a winner does not wish to receive the drawn prize, EAC will draw a new winner.

3.              HOW DO I ENTER THE CONTEST? No purchase is necessary to enter an EAC Contest.  Only one entry per contestant, per EAC Contest.  To enter an EAC Contest, you must subscribe to the KESKUS Newsletter and confirm agreement to the EAC Privacy Policy.  You may unsubscribe at any time.  You are solely responsible for ensuring that your entry or entries are properly submitted (including by properly completing any required registration fields)

4.             COULD MY ENTRY BE REFUSED OR REJECTED?  Your entry could be refused or rejected if: a) you fail to meet the EAC Contest’s eligibility criteria; b) you attempt to enter the EAC Contest in a manner not authorized by these Official Rules; c) your entry contains false or misleading information, or is late, falsified, illegible, or incomplete or otherwise irregular; d) your entry is submitted using robotic, automated, programmed, or other illicit means; or e) your entry is not in compliance with these Official Rules. In addition, EAC reserve the right to refuse any entry for any other reason in its sole discretion.

5.              WHAT ARE THE ENTRY CONDITIONS and HOW DO THE RELEASEES LIMIT THEIR LIABILITY?  By entering an EAC Contest: a) you agree to be bound by these Official Rules and by the decisions of EAC, which decisions are final; b) you agree that EAC shall have the right at any time to require proof of identity including that the contestant is the authorized account holder of the email address or social media account associated with the entry, or eligibility to enter the EAC Contest; failure to provide any such proof upon request may result in disqualification; c) you release and forever discharge EAC, its respective affiliates, and subsidiaries, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns, as well as any Third Party Services, (collectively, the “ Releasees”), and agree to indemnify and hold harmless each of the Releasees, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (i) your participation in, or inability to participate in, the EAC Contest, (ii) the awarding, receipt, possession, use, redemption or misuse of any prize, in whole or in part, or activity related to any prize, or your inability to receive, use or redeem any prize; (iii) your failure to comply with these Official Rules, or (iv) any breach of these Official Rules.  EAC will not be liable to you for any indirect, special, consequential, or punitive damages in connection with the EAC Contest or these Official Rules.

6.             ARE THERE ANY PRIZE CONDITIONS?  In addition to any prize conditions provided elsewhere in these Official Rules, any prize awarded in the EAC Contest is subject to the following conditions: a) The prize must be accepted as awarded, will be awarded to the confirmed winner only, and is not transferable, resellable or redeemable for cash;  b) EAC reserves the right to substitute any prize in whole or in part in the event that all or any component of the prize is unavailable, with a prize of equal or greater retail value; and, c) EAC does not make any representation or warranty, expressed or implied, regarding the quality or characteristics of the prize.  Any winner is solely responsible for coordinating use of any prize and for all taxes, fees, and expenses not otherwise set forth herein. Prizes may be subject to additional terms and conditions as imposed by prize suppliers.

7.             HOW WILL THE POTENTIAL WINNER(S) BE SELECTED?  For each of the Prizes to be awarded pursuant to these Official Rules, one entrant will be randomly selected on the Draw Date specified in the EAC Contest on the entry site as a potential winner and notified using the information provided at the time of entry. If any potential winner does not respond to such notification within 24 hours, declines a prize for any reason, or does not meet the requirements set forth in these Official Rules, as determined by EAC, the potential winner will be disqualified and, at EAC’s discretion, an alternate potential winner may be randomly selected from among remaining eligible entries, or the prize may be cancelled.

8.             HOW CAN A POTENTIAL WINNER BECOME A WINNER?  To be declared a winner, a potential winner: a) must correctly answer, unaided, a time-limited, mathematical skill-testing question to be administered by EAC; b) must comply with these Official Rules; c) must sign and return, within any designated time period, any documentation as reasonably required by EAC, which may include a standard release of liability and consent to publicity form; and d) may be required to provide proof of identification to confirm eligibility or to claim a prize.

9.             WHAT ARE THE ODDS OF WINNING A PRIZE?  The odds of winning depend on the number of eligible entries received.

10.           HOW DO I CLAIM A PRIZE?  Once a potential winner is confirmed as a winner, prize distribution will be promptly coordinated. Except as otherwise indicated by EAC, a winner must personally take delivery of the prize as instructed within four days of being notified that such prize is available or within such other time period as may reasonably be advised. If a winner fails to take delivery of the prize as instructed, the prize will be deemed forfeited.

11.             WILL I APPEAR IN ANY PUBLICITY IF I AM A WINNER?  If you are a winner, EAC may require you to appear in publicity related to the Contest or to any similar contest.  By entering the Contest, you consent to EAC’s use of your name, home town, photograph, voice and/or image for promotional and publicity purposes in all media used by EAC, without further notification, permission, payment or consideration.

12.           HOW WILL MY PERSONAL INFORMATION BE COLLECTED, USED AND DISCLOSED?  By entering the EAC Contest, you consent to EAC’s collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at https://www.estoniancentre.ca/privacy-policy-1 (the “EAC Privacy Policy”), for purposes of administering the EAC Contest as described in these Official Rules or as otherwise required or permitted by applicable law.

13.           WHAT LAWS APPLY TO THE CONTEST?  The EAC Contest and these Official Rules are governed by the laws applicable in Ontario. Any disputes, claims or causes of action arising out of or connected with the EAC Contest, prize or these Official Rules will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of Ontario.

14.           CAN EAC CANCEL OR AMEND THE CONTEST?  EAC reserves the right to amend the Official Rules or to terminate any EAC Contest at any time without liability to any contestant.  For example, if for any reason the Contest is not capable of running as originally planned, EAC may adjust any of the dates, timeframes or other EAC Contest mechanics, or suspend or cancel the Contest. You may not amend these Official Rules in any way.

15.           WOULD EAC EVER DISQUALIFY OR BAN SOMEONE FROM AN EAC CONTEST?  EAC may disqualify without notice or ban someone from the EAC Contest or any future contest for any other reason, including if EAC find that a person has: a) resold or attempted to resell a prize, in whole or in part; b) tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the EAC Contest; c) provided false or misleading information; d) acted in disruptive manner, or with the intent to annoy, abuse, threaten or harass any person; or e) otherwise violated these Official Rules.

16.           WHAT HAPPENS IF THESE OFFICIAL RULES CONTRADICT OTHER CONTEST MATERIALS?  In the event of any discrepancy or inconsistency between these Official Rules and disclosures or statements made by EAC or appearing in other EAC Contest-related materials, these Official Rules shall govern.
